1. Acceptance of Terms

Welcome to GateOne. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GateOne ("we," "us," or "our") regarding your use of the GateOne mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1.1 Age Requirement

You must be at least 13 years old to use GateOne. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the App.

By using the App, you represent and warrant that you meet the age requirement and have the authority to accept these Terms.

2. Description of Service

2.1 What GateOne Is

GateOne is a mobile application designed to help users reduce screen time and build better digital habits. The App works by:

• Blocking access to selected "distracting" apps on your device
• Requiring you to answer educational questions before accessing blocked apps
• Providing educational content in the form of vocabulary, math, coding, and general knowledge questions

2.2 Platform Availability

GateOne is available on:

• iOS devices running iOS 15.0 or later (via the Apple App Store)

2.3 What GateOne Is Not

GateOne is not:

• A parental control app
• A guarantee of reduced screen time or improved productivity
• Medical or psychological treatment for addiction or compulsive behaviors
• An educational platform that replaces formal education
• A foolproof blocking mechanism (users can uninstall or disable the app)

3. User Responsibilities

3.1 Proper Use

You agree to use GateOne only for its intended purpose: helping you build better digital habits. You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to bypass, disable, or interfere with the App's blocking mechanism through technical means
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Use the App to harm, harass, or infringe on the rights of others
• Attempt to gain unauthorized access to the App's systems or networks

3.2 Device Permissions

GateOne requires certain device permissions to function properly:

• Screen Time API (iOS): To monitor and block app usage
• Notifications: To alert you about the App's status

You are responsible for granting these permissions. The App may not function properly if permissions are denied.

3.3 Account Security

While GateOne does not require an account, your subscription is tied to your Apple ID. You are responsible for:

• Maintaining the security of your Apple ID
• All activities that occur through your subscription
• Notifying us immediately of any unauthorized use

4. Subscription Terms

4.1 Subscription Plans

GateOne offers subscription plans. Subscription features include unlimited app blocking, all question categories, custom difficulty levels, no ads, and priority support.

4.2 Free Trial

We may offer a free trial period for new users. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID at confirmation of purchase.

4.4 Cancellation

You can cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the subscription expires.

4.5 Refund Policy

All subscription purchases are processed through Apple, and refunds are handled according to Apple's policy:

4.6 Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect at the start of your next billing period after we notify you. If you do not agree to a price change, you may cancel your subscription.

5. Intellectual Property

5.1 Ownership

GateOne and all its content, features, and functionality (including but not limited to software, text, images, graphics, logos, and questions) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

5.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code of the App
• Use the App's content for commercial purposes
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices

5.4 Question Content

The educational questions provided in the App are created by us or licensed from third parties. You may not copy, reproduce, or distribute these questions outside the App.

6. Disclaimers and Limitations of Liability

6.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 No Guarantee of Results

We do not guarantee that using GateOne will:

• Reduce your screen time by any specific amount
• Improve your productivity or focus
• Help you break habits or form new ones
• Provide educational benefits or improve your knowledge
• Work perfectly on all devices or in all situations

Results vary from person to person. The App is a tool, not a guarantee.

6.3 Technical Disclaimers

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The App will function properly on all devices or operating systems
• Any errors or defects will be corrected
• The App will meet your specific requirements
• The blocking mechanism cannot be bypassed (users can always uninstall the app)

6.4 Not Professional Advice

GateOne is not a substitute for:

• Medical advice, diagnosis, or treatment
• Psychological counseling or therapy
• Addiction treatment or recovery programs
• Formal education or tutoring
• Parental supervision or control

If you have concerns about excessive screen time, digital addiction, or related issues, please consult with a qualified healthcare provider.

6.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of the App
• Any interruption or cessation of the App
• Any bugs, viruses, or other harmful code in the App
• Any errors or omissions in the App's content
• Any harm resulting from your use of the App

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is less.

6.6 Device Issues

We are not responsible for:

• Damage to your device from using the App
• Battery drain or performance issues
• Conflicts with other apps on your device
• Data loss or corruption
• Any issues with your device's operating system

7. Indemnification

You agree to indemnify, defend, and hold harmless GateOne, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

8. Termination

8.1 Our Right to Terminate

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

8.2 Your Right to Terminate

You may stop using the App at any time by uninstalling it from your device. To cancel your subscription, follow the instructions in Section 4.4.

8.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You must uninstall the App from your device
• All licenses granted to you under these Terms will terminate
• You will not receive a refund for any remaining subscription period
• All data stored locally on your device will remain until you delete it

9. Changes to Terms

9.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you through the App or via email (if we have your email)
• Post the updated Terms on our website

9.2 Your Acceptance

Your continued use of the App after we make changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App and cancel your subscription.

9.3 Material Changes

For material changes that significantly affect your rights, we will provide at least 30 days' notice and may require you to affirmatively accept the new Terms before continuing to use the App.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which GateOne is registered, without regard to conflict of law principles.

10.2 Dispute Resolution

If you have a dispute with us, we encourage you to first contact us at contact@easy-carb.site to try to resolve the issue informally.

10.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

10.4 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights without first engaging in arbitration.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GateOne regarding the App and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

11.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

11.6 Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet service disruptions.

12. App Store Terms

12.1 Apple App Store

If you download the App from the Apple App Store, you agree that:

• These Terms are between you and GateOne, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for any claims related to the App
• You will comply with Apple's App Store Terms of Service

14. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING GATEONE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
